A man sat at a metro station in Washington DC and started to play the violin; it was a cold January morning. He played six Bach pieces for about 45 minutes. During that time, since it was rush hour, it was calculated that thousands of people went through the station, most of them on their way to work.

Three minutes went by and a middle aged man noticed there was musician playing. He slowed his pace and stopped for a few seconds and then hurried up to meet his schedule.

A minute later, the violinist received his first dollar tip: a woman threw the money in the till and without stopping continued to walk.

A few minutes later, someone leaned against the wall to listen to him, but the man looked at his watch and started to walk again. Clearly he was late for work.

The one who paid the most attention was a 3 year old boy. His mother tagged him along, hurried but the kid stopped to look at the violinist.

Finally the mother pushed hard and the child continued to walk turning his head all the time. This action was repeated by several other children. All the parents, without exception, forced them to move on.

In the 45 minutes the musician played, only 6 people stopped and stayed for a while. About 20 gave him money but continued to walk their normal pace. He collected $32. When he finished playing and silence took over, no one noticed it. No one applauded, nor was there any recognition.

No one knew this but the violinist was Joshua Bell, one of the top musicians in the world. He played one of the most intricate pieces ever written,with a violin worth 3.5 million dollars.

Two days before his playing in the subway, Joshua Bell sold out at a theater in Boston and the seats average $100.

was organized by the Washington Post as part of a social experiment about perception, taste and priorities of people. The outlines were: in a commonplace environment at an inappropriate hour: Do we perceive beauty?

Do we stop to appreciate it? Do we recognize the talent in an unexpected context?

One of the possible conclusions from this experience could be: If we do not have a moment to stop and listen to one of the best musicians in the world playing the best music ever written, how many other things are we missing?

During the past year, three women have risen above the rest and have made us cry, made us laugh and made us think. Adele, Melissa McCarthy and Octavia Spencer delivered solid performances in the music, TV and film arenas. Not only did they deliver box office success, but also managed to earn critical acclaim, a rare overlap for most entertainers. Additionally, they crossed both, the generational divide as well the political gender line, surprising audiences with their talent.

At the timing of this blog, Melissa McCarthy has won an Emmy for her work on the CBS comedy Mike and Molly and was also nominated for an Oscar for her roaring delivery in Bridesmaids, in the Best Performance by an Actress in a Supporting Role category. Octavia Spencer is nominated in the same category for her memorable work in The Help. And Adele is nominated for six Grammy Awards, including the Song, Album and Record of the Year. She’s previous won two for her freshman album 19.

All three women changed the game of what it means to look like in a fickle industry that expects its women to be blond, size zero and, if necessary, cut by a surgeon to do so. At least for now, they have stayed true to themselves and instead of hiding under their skin, revealed to everyone that genuine talent comes from within. This is in tremendous contrast with manufactured celebrity, which focuses solely on the package, where the essence of the spirit may or may not exist.

These things are also not mutually exclusive and it would be foolish to assume otherwise. Lady Gaga, while tiny in size, is tremendous in her entertainment abilities and if she continues to play her cards right, will have a long and fruitful career path. But, what finally got people to pay attention to this musical prodigy, living in a city full of creative geniuses where she wasn’t getting noticed, was stripping down to almost nothing and emerging as a go-go dancer. And then the Lady Gaga conversations began. Of course, she has real chops to back up all that attention.

For fat girls, often called big, curvy voluptuous or womanly, getting naked in public in order to get attention is not an option. Not if they want to be taken seriously. On the flip side, as I often tell my film students, watching a movie where a fat guy falls down the stairs is funny. And numerous male actors know this, fully aware that the double standard exists.

Take for example Couples Retreat, a truly comical tale of what happens when four couples, in various states of their relationships, travel to a beautiful, remote location to face their partners’ concerns. Vince Vaughn, Jason Bateman, Faizon Love and Jon Favreau play the male characters, teamed up with their significant others, played by Malin Akerman, Kristen Bell, Kristin Davis and Kali Hawk. There’s one specific scene where the men face the women and everyone is stripped down to their beach attire. Within one split second it becomes evidently clear that all the women are rockin’ size zero and size 2 bodies while all the men, sans Bateman, could benefit from months with a trainer if they wanted to match the physique of their female counterparts.

This scene made me wonder, how would the audience react if a film showed the exact same scene, where the body types were reversed: where the men were all in their physical prime and the women – thirty to fifty pounds overweight – made us laugh via their character delivery vs. their body type? Would we as the audience buy it? Would the actresses ever agree to it? Would a studio executive ever green-light it?

I’m not saying that fat isn’t a serious issue – America’s obesity epidemic is at an all time high and kids’ diabetes right there with it. Our food is over processed and over treated with chemicals. Our fruits and vegetables are picked too early and lack flavor, all the while have grown in size. Our animals eat feed full of hormones, which may be leading to premature adolescence in children. Many of us spend way too much time in front of screens, giving our fingers and wrists the exercise that our bodies desperately crave. And right around this time, beginning of February, many Americans quit the New Year’s resolutions of weight loss, neglecting the gym in favor of evening tv and a bowl of ice cream. I know this first hand.

So, yes, we do have a weight problem and for those of us not pre-dispositioned with skinny genes that help us fit into skinny jeans, for the many of us for whom the size of our hips or thighs or stomachs have been an on-going issue since puberty, and for those of us for whom neither surgery nor diet pills is an option, weight is an ongoing issue, making us think twice about everything: from the sexy skirt we’re craving to buy to the confidence needed to make a great impression on a first date or a job interview.

The weight comes first.
Everything else we may bring to the table comes second.
It’s a pain and reality for many. We know the gym and a healthy diet is our responsibility, the world has done a fantastic job of reminding us, every hour, of this fact. And media, with Photoshop at its side, has altered how even the most thin, the most beautiful and the most ideal look to us. Only we know what it means and how scary the thought of just how much of ourselves we have to invest from a time and conscious decision-by-decision lifestyle (food, activity, company, lifestyle) of what it would take to make the body smaller.

Jennifer Hudson did that. The woman has lost over 70 pounds and while there’s a part of me that would like to think that with her celebrity status, bank account and Weight Watchers, her food, trainers and support system pave the way for health success. Of course, it was Jennifer who did the work. And while she won her Oscar for Dreamgirls (also for the best Supporting Actress category) while still a full size and before her transformation, back then she was the homely looking girl with the voice: now she’s a superstar.

In today’s physically-obsessed standard, a woman can be a drug addict, alcoholic, adulterer, abuser or pathological liar. She can be selfish, uneducated, terrible with her budget, professionally irresponsible or even downright glib, but if she looks hot in a miniskirt, most of society will forgive all her faults and open their doors and hearts to whatever her legs will bring.
On the flip side, if she has super high IQ, is at the top of game at work, gives back to her community and is a wonderful friend to her social circle, and, simultaneously, a size 20, she’s outcast. We’ve outcasted her. The bigger she is, the more invisible we’ve made her feel.

No-one is rooting more for Adele, McCarthy and Spencer more than I am. McCarthy also grew up around Chicago. And Adele’s album was produced by Rick Rubin, whom I once briefly met in Mexico, about fifteen years ago. While I don’t share any personal connection with Spencer, as a Soviet immigrant kid living in urban housing projects for three years at the height of the Cold War, I have a sense of what it means to be an outsider, looking in. Additionally, I draw most of my life’s energy from television, music and film, so what these incredible three women do holds a very special space in my heart and mind.

Their individual paths, my guess, were not easy. They probably had to work (and still do) ten times as hard as their thinner peers to prove their worth in a package-focused business that values glamor above intention, the dollar above all. But what they also managed to do was carve out a path for so many other women who wake up daily feeling insecure about their imperfect bodies first, what they can contribute to the world second. And for this, Adele, Melissa and Octavia, I thank you.

The old Agora and the original Euclid Tavern get most of the love when people are asked to name the greatest rock clubs in Cleveland history. And they certainly were great places to see live music, part of the legend and the lore of Cleveland rock 'n' roll. But when I think back on the best club shows I’ve seen in Cleveland, my mind more often wanders to the late 1980s and early 1990s and sweaty, smoky, boozy nights at Peabody’s DownUnder on Old River Road in the Flats.
Peabody’s, one of the flagships of the Flats, opened in 1981 when Dewey Forward and partner Tom Rutzen bought the old Pirate’s Cove nightclub. It wasn’t much to look at -- dark and dingy and literally underground. It was freezing in the winter, sweltering in the summer, had balky plumbing and frequently smelled like fish when it rained. But put a band and a crowd together in that club and Peabody’s became a rock 'n' roll palace. There was something about the room – the layout, the acoustics or maybe just the seen-it-all grit on the walls – that made it the perfect space to see a rock band in full glory.
Part of the magic was the people who booked the shows, first Forward, a '60s student activist who started producing concerts as a senior at the University of Hartford in Connecticut. Forward knew rock 'n' roll, and when he came back to Cleveland in the early 1970s he immersed himself in the city’s burgeoning music scene, opening his first concert club in 1977: Peabody’s Café in the old Cellar Door space in Cleveland Heights.
At Peabody’s DownUnder, Forward hit on a winning formula, featuring national bands on their way up (R.E.M. played an early gig there), plus regular gigs by local favorites like Wild Horses, the Janglers and the Buckeye Biscuit Band. He loved to put the spotlight on great Cleveland acts, booking bands like Devo and Pere Ubu. And he loved jazz, too: Dizzy Gillespie celebrated his 70th birthday with a show at Peabody’s.
Forward handled day-to-day operations until 1988, when he leased the club to music-loving brothers Tony and John Ciulla. The Ciullas ran Peabody’s for two years before leaving in 1990 to open the Empire Concert Club on East Ninth Street. Tony went on to become a high-profile rock manager, with clients such as Marilyn Manson. John managed Blossom Music Center for a time, before moving to California to manage concert venues there.

After the Ciullas, Forward turned over the booking to Larry Collins, a successful independent concert promoter with deep ties to the national punk and alternative rock scenes. Collins now owns the City Buddha, a popular shopping spot on Coventry Road in Cleveland Heights.
It was in the latter years that I became a Peabody’s DownUnder regular, part of my job then as a music critic at The Plain Dealer. I was there on April 2, 1992, when Pearl Jam, already national stars because of the success of their debut album, “Ten,” lived up to a contractual agreement and played a previously booked club date at Peabody’s. Longtime Plain Dealer rock writer Jane Scott, then just shy of her 73rd birthday, was there with me, and I can still see her scribbling away in her reporter’s notebook as Eddie Vedder & Company melted the Peabody’s walls with an encore of Neil Young’s “Rockin' in the Free World.”
I was there, too, in the summer of 1992, when Tori Amos, the piano-playing singer-songwriter with the blaze of tangled red hair, made her Cleveland debut, transfixing the Peabody’s audience with her performance, even as raw sewage from the club’s backed-up toilets flooded the floor. No one seemed to notice – or care -- that their shoes were under a murk of water.
Other memories? There was Paul Westerberg, former lead singer of The Replacements, capping a two-hour, 22-song performance in August 1993 with a solo acoustic version of "Here Comes a Regular," delivered as part encore, part whiskey-soaked prayer. There were nights with the Janglers, a Cleveland jam band that spun magic from the talents of singer/guitarist Jason White and and lead guitarist Jack Silverman.
It was a special place.
Forward sold Peabody's DownUnder in 1995 and opened Pete & Dewey’s Planet, a restaurant on Huron Road across from what was then Jacob’s Field. He’s now the proprietor of Dewey’s Coffee Café in Shaker Heights and the Chagrin Falls Popcorn Shop in Chagrin Falls.
Peabody’s continued to showcase live music for a few more years in the Flats before being converted into a dance club. The new owners later moved the live-music venue to a new location in the back of the Rascal House restaurant at Euclid Avenue and East 21st Street on the Cleveland State University campus. They shortened the name to Peabody’s Concert Club and are still booking touring alternative rock acts and local artists.

THE PLAY:
Anyone Can Whistle is a musical about political corruption and the very fine difference between sanity and conformity. The Mayoress, Cora Hoover Hooper, has led her town into bankruptcy. To save the town she creates, with the help of her merry band of corrupt city workers and politicians, a miracle which she hopes will attract paying tourists to her city. Unfortunately for her during the tourist rush, the inmates of the local asylum, called the Cookie Jar, escape and 'mix' with the tourists. A doctor named Hapgood surfaces and claims to be able to identify the ‘cookies’ from the sane members of society. Nurse Fay Apple, who let her ‘cookies’ escape by accident, reappears as a consultant from Lourdes. Hapgood and Apple hook up; maybe. Does the Mayoress's plan work? Will hilarity ensue? Perhaps one of the bravest shows Stephen Sondheim has written (along with Assassins.... and Sweeney Todd.... and Pacific Overtures and..Follies and... oh never mind). Whistle contains a wonderfully haunting score and wonderful book that will resonate more today than when first produced in 1964. This will be the first professional production of Anyone Can Whistle since it was done in the early seventies at Cain Park. @Bonersoup183 I'm in my 40's grew up around these guys in arizona....Great times. We were few and our shit was not popular, we were not popular. Shit material music and people existed then as well. Our music was not on the radio here in AZ. Word of mouth and shows is all we had. Btw no surfing in arizona yet. JFA had a great surf sound but It was all skateboarding here.

Hey man, im 17 and i was exactly where you are now. Ive always been different and shit. I i used to dwell in the past too. Truth is though man, there is a SHIT LOAD of really good music going on right now. The Night Birds just came out with most of their shit last year, its surf punk at its finest. Also bands like OFF! and Cerebal ballzy are doin some sick shit with hardcore. The very esscense of punk is DIY too. If its not going on, do it yourself. Start a band, zine, anything!

I'm 13 and wish I was around in this time. Not with this stupid materialistic kids I have to deal with at school. It pisses me off that I have to bear with all this shitty music now of days. Fucking kesha and lady gaga. I would kill to be in the 80's, going to jfa shows and surfing with friends.

Most sign up to get free college or to shirk responsibilities like parenthood. Many people may be under the misconception that the Music Division only collects music. Despite our division’s title, the name of our reading room, Performing Arts, actually describes our holdings far more accurately. So, in addition to music, we also boast amazing collections that document theater and dance. Today is perfect to herald one of our most prized dance collections, the archives of the Alvin Ailey Dance Foundation. You can see highlights from this collection in the online exhibit, Alvin Ailey American Dance Theater: 50 Years Cultural Ambassador to the World.

Born January 5, 1931, Alvin Ailey is celebrated as both a brilliant choreographer of modern dance and as an activist who promoted and ensured the presence of African-American dancers both in the United States and around the world. He became serious about dance when he met Lester Horton, another pioneer of American modern dance (and another dance icon whose collection is in our custodial care). Ailey went on to form his own company, the Alvin Ailey American Dance Theater. Today, 125 boxes of archival materials, spanning from the company’s start in 1958 to 2008, are available for our patrons to see and study here in our reading room. Among their contents are choreographic commissions and teaching notes, photographs, correspondence and business papers, as well as production documents, costume designs, programs, publicity, and moving images (available at our sister division, Motion Picture, Broadcasting and Recorded Sound).

People often equate archivists and “gatherers”: we are that indeed. But our collecting is far from hoarding – we collect to share with the world. And on days like today, we also celebrate the lives and careers of the creators whose papers we preserve.

The humble menu bar is a fascinating part of the Mac OS X interface. It’s always visible, and holds a remarkably prominent position on your display – far more so than the Dock.
Some people love to keep it as empty as possible, while others have so many menu bar apps that it’s literally full to overflowing. Whichever camp you fall into, almost everyone has at least one or two apps that they feel are worthy of a place in the magical menu bar.
Today we’re going to take a close look at 25 different apps that offer really useful menu bar functionality. Each has a short description, and a example video of the app in-use.
I’m not for one moment suggesting that you download and run all of these. That would be crazy. Rather I hope that you’ll find one or two that particularly stand out for you, and become a permanent resident in the top-right corner of your display…
FuzzyClock
Often you don’t need the exact time in hours, minutes and seconds. A more human readable style like “five past ten” makes more sense. FuzzyClock is a menubar clock which displays the current time in a “fuzzy” style.
I find this to be particularly useful as it removes the temptation to worry about one minute of time here or there. It also removes the mindless “clock watching” you may find yourself falling into, just watching the minutes tick by!

Radium
If you’re a little tired of your iTunes music collection, Radium offers a simple way to tune in to thousands of online radio stations. The execution is wonderfully minimal, with basic search functionality and the ability to mark your favourite tracks for easy access.
We’ve reviewed Radium in the past, and I’m a big fan. Various preferences let you scrobble music to Last.fm, integrate with Growl, or even hook Radium up to subscription radio services such as Sirius, Sky.fm, and various others.

ExpanDrive
There’s no shortage of FTP applications on OS X, but our readers seem to be dedicated Transmit fans.
I was interested to see how few people use ExpanDrive. This is a menu bar app that’s capable of mounting an FTP volume on your local desktop, which acts in completely the same way as a physically attached USB drive. It’s a whole new way to work with FTP, and an absolute must-see.

Take Five
Take Five is the latest creation to come from the Iconfactory, bringing their popular iOS app to the desktop. Take Five gives you a simple way to quickly pause your music, and have it resume after a certain amount of time (five minutes, by default).
Although a simple idea, this comes in handy more often than you’d think. The interface is beautiful, and it’s a menu bar app that’s well worth giving a try.

RescueTime
If you’ve ever reached the end of the day and found yourself wondering where your time went, RescueTime might be just what you need. Although more of a web app than a desktop app, the menu bar agent keeps track of all the apps, documents, and websites used throughout the day.
You can then login to the RescueTime site to see a breakdown of all this information, and figure out what you need to cut out to improve productivity!

TinyAlarm
As the name would suggest, TinyAlarm is a quick way to set an… alarm. You can either select a time from a pre-selected list, or specify one using the OS X clock widget. When the time arrives, TinyAlarm will notify you with a message and sound.
All these are customisable in preferences, and there are plenty of different sounds to choose from – some better than others! You can also select a “snooze” interval, for when you want to delay the alarm by a few minutes.

Caffeine
Although it can be very handy to have a computer that automatically put itself to sleep after a certain period of inactivity, there are times when this can be a real nuisance (when listening to music, or watching a film).
Caffeine gives you an attractive menu bar icon that can quickly enable or disable your Mac’s automatic sleep functionality with a single click.

Jumpcut
Jumpcut is a simple way to store the items you copy to your clipboard for later reference. Rather than each new item overwriting the previous, you can recall them at any time with a few keystrokes.
Although many applications offer this functionality (Alfred, for one), it’s handy to have a single-serving app for the purpose of supercharging your clipboard!

AllBookmarks
Bookmarks and favourites are probably the most-used feature of web browsers, and I don’t need to explain how helpful they can be for heavy web users. AllBookmarks puts your browser bookmarks right in the menu bar – for all major OS X browsers.
You can navigate through your bookmark folder structure, and go to a website with a single click. From the developers of the excellent 1Password, this is a fantastic utility to have at your fingertips.

Fluid
Fluid is a fairly unique piece of software, designed to create a “SSB” (site specific browser) for your favourite websites and web applications. This creates a dedicated native application for a particular website that can be placed in your Dock.
An interesting feature of Fluid is the ability to create an SSB that attaches to your menu bar and displays as a small drop-down window. This works particularly well for using mobile-optimised websites, such as mobile Gmail as shown in the example above.

FaceTab
As if Facebook wasn’t already enough of a drain on international time and attention, FaceTab offers a way to make accessing the social networking site even easier. Just click the icon in your menu bar, and you’ll be able to navigate around the majority of what Facebook has to offer.
You can check your wall, post messages, comments, browse photos, and see any pending notifications – all without actually opening the Facebook site. It’s actually a very well-executed piece of software, but won’t help those of you with a Facebook addiction…

iStat Menus
Even if the immediate idea of a series of live statistics in your menu bar doesn’t particularly appeal, don’t write iStat Menus off. It’s far more versatile that you might expect, and can be a very useful tool for digging into system information. The interface is beautifully designed – as you’d expect from Bjango.
You don’t need to automatically display every available option, but certain pieces of information can be useful to have at your disposal. There’s a 14 day trial available that should give you a good idea of how the app works and whether it’s for you.

SpaceControl
Although the storage capacity of hard drives seems to be ever-increasing, since installing an SSD I have begun to keep closer track of the data that’s eating up space on my drive. It feels good to be back in control, without a hard drive that’s full of scattered information.
SpaceControl gives you a really simple way to keep track of the space available on one (or several) hard drives, and receive notifications when you’re running a little low on space. Though not particularly packed with functionality – you could do the same thing with AppleScript – it’s a handy utility for a couple of dollars.

Isolator
Concentrating on a single application at any one time can be a frustrating problem for computer users. There are so many different distractions present – from Twitter and Facebook, to your bouncing email icon – that it’s difficult to keep focus.
Isolator aims to help this problem by, when enabled, only showing one application at a time. The rest of the screen can either be blurred, or “isolated” completed with a single colour. Although not as advanced as a solution such as Concentrate, it’s a great free option.

WeatherBug Alert
Although there seems to be a wealth of different weather apps available for iOS, the same isn’t really true for the Mac. Maybe it’s because dedicated weather websites offer so much information for free that it can be hard to compete.
WeatherBug Alert for Mac helps you plan your day with confidence by putting severe weather alerts and your live temperature on your desktop. It also contains links across to the full forecast at the Weatherbug.com site.
Although it would be good to have these integrated into the app, this simple menu bar widget won’t cost you a cent (and so it’s hard to complain!)

F.lux
If you often use your computer into the early hours of the morning, you’ll be familiar with how frustrating a bright computer screen can be with the rest of the room in relative darkness. It definitely isn’t good for your eyes!
F.lux serves the interesting purpose of adjusting your screen colour to be better suited for night-time viewing. There are various preferences to tweak how this happens, and it can be a very handy utility for nocturnally-inclined readers.
Just don’t use it if you’re planning on doing any design work that relies on colour, as you’ll stand to be shocked when returning to your computer in the morning!

SMARTReporter
Although you should certainly be backing up on a regular basis, there’s no harm in also keeping an eye on the ongoing health of your hard drive. Many new models integrate SMART (Self-Monitoring, Analysis, and Reporting Technology), a technology that detects and reports on various indicators of reliability, in the hope of anticipating drive failures.
SMARTReporter sits in your menu bar as an ongoing reminder that your drive is in a good condition. If any problems occur, you’ll be notified in advance so that you can double-check your backups and look into purchasing a new drive!

Spirited Away
We’d all love to have a faster processor in our Mac, but what if there was a way to make better use of the processing power you already have? Spirited Away makes it easy to automatically “pause” a particular application, and stop it using any processing power if it’s been inactive for a period of time.
You can choose to exclude certain applications (for instance, you might be watching a video in your browser and would prefer it not to “pause”), and select preferences relating to the inactivity time.

Dejumble
“Not another to-do list”, I hear you say. There are certainly enough task managers available to completely overflow your Applications folder, but Dejumble takes a slightly simpler approach to most. It has a unique interface, differentiating itself from the usual Mac experience.
You have a task inbox, a list of projects, and simple search functionality. Although it doesn’t technically drop down from your menu bar, it feels more akin to a menu application rather than a traditional piece of software.

Notify
If you’re looking for a simple email client that resides in your menu bar, Notify is very likely to fit the bill. You can add multiple accounts, check, read, and reply to messages. Notify supports mutliple accounts, including Gmail/Google Apps, MobileMe, and Rackspace Email. All in a beautiful interface.
Rather than replacing your current email client (although it could, in theory), Notify is meant to be a way to stay up-to-date with new messages, filing those that don’t warrant your attention, deleting spam, and firing back simple replies.

MailCue

MailCue is another email client that sits in your menu bar, but offers a more full-featured interface and experience that Notify. This isn’t necessarily better, and it all depends upon how you’d like to interact with your new emails and messages.
Particularly welcome is the functionality to “sleep” an email account, so that you can leave email alone and get down to work when needed.

Ejector
Ejecting volumes has long been a frustrating process in OS X – both for virtual, software volumes and physical devices as well. To do so, you’re required to either open Finder and click eject next to the drive name, or head over to your desktop to right click > Eject.
Ejector makes the process a little bit quicker, by listing all mounted volumes in your menu bar and giving you a one-click location to eject them. Particularly handy for ejecting all volumes if you’re wanting to unplug your laptop to take with you!

Desktopple
Desktopple gives you a few unique and interesting ways to experiment with, clean up, and interact with your desktop. A key piece of functionality is a quick button to hide all the icons, folders, and drives on your desktop – they’re replaced with an image or wallpaper of your choosing.
It can also automatically hide windows that haven’t been used for a while (“Window Cleaning”), or dim your menu bar to further reduce distractions when working.
Desktopple is particularly handy if you regularly find yourself giving a presentation – or if you just hate desktop clutter!

MenuPrefs
MenuPrefs does more or less exactly what you’d expect – puts System Preferences right in your menu bar! Depending on how often you find yourself dipping into System Preferences, you may find this amazingly useful or slightly unnecessary.
It’s certainly very handy to be able to jump straight to a particular preference pane, rather than bringing up the main System Preferences window first.

Radley Balko: SWAT Raids, Stun Guns, And Pepper Spray: Why The Government Is Ramping Up The Use Of Force

In February of last year, video surfaced of a marijuana raid in Columbia, Mo. During the raid on Jonathan Whitworth and his family, police took down the door with a battering ram, then shot and killed one of Whitworth's dogs within seconds of entering the home and they wounded the other. They didn't find enough pot in the home to charge Whitworth with even a misdemeanor. (He was, however, charged with misdemeanor possession of drug paraphernalia when police found a pipe.) The disturbing video went viral in May 2010, triggering outrage around the world. On Fox News, conservative columnist Charles Krauthammer and Bill O'Reilly cautioned not to judge the entire drug war by the video, which they characterized as an isolated incident.

In fact, very little about the raid that was unusual. For the most part, it was carried out the same way drug warrants are served some 150 times per day in the United States. The battering ram, the execution of Whitworth's dog, the fact that police weren't aware Whitworth's 7-year-old child was in the home before they riddled the place with bullets, the fact that they found only a small amount of pot, likely for personal use -- all are common in drug raids. The only thing unusual was that the raid was recorded by police, then released to the public after an open records request by the Columbia Daily Tribune. It was as if much of the country was seeing for the first time the violence with which the drug war is actually fought. And they didn't like what they saw.

That video came to mind with the outrage and public debate over the now-infamous pepper-spraying of Occupy protesters at the University of California-Davis protest earlier this month. The incident was just one of a number of high-profile uses of force amid crackdowns on Occupy protesters across the country, including one in Oakland in which the skull of Iraq War veteran Scott Olsen was fractured by a tear gas canister, and in New York, where NYPD Officer Anthony Bologna pepper-sprayed protesters who had been penned in by police fencing.

But America's police departments have been moving toward more aggressive, force-first, militaristic tactics and their accompanying mindset for 30 years. It's just that, with the exception of protests at the occasional free trade or World Bank summit, the tactics haven't generally been used on mostly white, mostly college-educated kids armed with cellphone cameras and a media platform.

Police militarization is now an ingrained part of American culture. SWAT teams are featured in countless cop reality shows, and wrong-door raids are the subject of "The Simpsons" bits and search engine commercials. Tough-on-crime sheriffs now sport tanks and hardware more equipped for battle in a war zone than policing city streets. Seemingly benign agencies such as state alcohol control boards and the federal Department of Education can now enforce laws and regulations not with fines and clipboards, but with volatile raids by paramilitary police teams.

Outraged by the Occupy crackdowns, some pundits and political commentators who paid little heed to these issues in the past are now calling for a national discussion on the use of force. That's a welcome development, but it's helpful to review how we got here in order to have an honest discussion.

Part of the trend can be attributed to the broader tough-on-crime and drug war policies pushed by politicians of both parties since at least the early 1980s, but part of the problem also lies with America's political culture. Public officials' decisions today to use force and the amount of force are as governed by political factors as by an honest assessment of the threat a suspect or group may pose. Over the years, both liberals and conservatives have periodically raised alarms over the government's increasing willingness to use disproportionately aggressive force. And over the years, both sides have tended to hush up when the force is applied by political allies, directed at political opponents, or is used to enforce the sorts of laws they favor.

How We Got Here

According to Eastern Kentucky University criminologist Peter Kraska, the number of SWAT raids carried out each year in America has jumped dramatically over the last generation or so, from just a few thousand in the 1980s to around 50,000 by the mid-2000s, when Kraska stopped his survey. He found that the vast majority of the increase is attributable to the drug war -- namely warrant service on low-to-mid-level drug offenders. A number of federal policies have driven the trend, including offering domestic police departments military training, allowing training with military organizations, using "troops-to-cops" programs and offering surplus military equipment and weaponry to domestic police police departments for free or at major discounts. There has also been a constant barrage of martial rhetoric from politicians and policymakers.

Dress cops up as soldiers, give them military equipment, train them in military tactics, tell them they're fighting a "war," and the consequences are predictable. These policies have taken a toll. Among the victims of increasingly aggressive and militaristic police tactics: Cheye Calvo, the mayor of Berwyn Heights, Md., whose dogs were killed when Prince George's County police mistakenly raided his home; 92-year-old Katherine Johnston, who was gunned down by narcotics cops in Atlanta in 2006; 11-year-old Alberto Sepulveda, who was killed by Modesto, Calif., police during a drug raid in September 2000; 80-year-old Isaac Singletary, who was shot by undercover narcotics police in 2007 who were attempting to sell drugs from his yard; Jonathan Ayers, a Georgia pastor shot as he tried to flee a gang of narcotics cops who jumped him at a gas station in 2009; Clayton Helriggle, a 23-year-old college student killed during a marijuana raid in Ohio in 2002; and Alberta Spruill, who died of a heart attack after police deployed a flash grenade during a mistaken raid on her Harlem apartment in 2003. Most recently, voting rights activist Barbara Arnwine was raided by a SWAT team in Prince George's County, Md., on Nov. 21. The police appear to have raided the wrong house.

The drug war has been the primary policy driving the trend but, since 2001, the federal government has also used the threat of terror attacks to further militarize domestic law enforcement. This includes not only finding new sources of funding for armor, weapons and gear, but also claiming new powers for the "War on Terror" that are then inevitably used in more routine law enforcement.

But paramilitary creep has also spread well beyond the drug war. In recent years, SWAT teams have been used to break up neighborhood poker games, including one at an American Legion Hall in Dallas. In 2006, Virginia optometrist Sal Culosi was killed when the Fairfax County Police Department sent a SWAT team to arrest him for gambling on football games. SWAT teams are also now used to arrest people suspected of downloading child pornography. Here is a step-by-step guide to setup parental control restrictions on the iPad with OS 3.2. This is a follow-up Knol to the hugely popular How To Setup Parental Controls on iPhone & iPod Touch (OS 3.x Edition). Though this page is long, the steps are generally intuitive and easy to follow. General Parental Control Restrictions Setup
From the home screen, select Settings > General.

Select Restrictions. If you haven't done this before, select Enable Restrictions.

Enter a 4-digit passcode. Make sure you remember this passcode, in case you need to change these settings.

You will see the restrictions screen. Set Safari, YouTube, and Installing Apps to OFF on this screen.
NOTE: Some parents may choose to allow apps to be installed with age restrictions setup, but be aware that there are still issues with the age-based ratings and browsing the App Store itself.

Scroll down the screen to the Allowed Content area.

Set In-App Purchases to OFF.

Select Music & Podcasts. Set Explicit to OFF.

Select Movies. Select the rating you would like to allow.

Select TV Shows. Select the rating you would like to allow.

Select Apps. Select age-based filtering for apps you would like to allow.

Hit the Home button to return the home screen.

This week marks the inauguration of the Copyright Office’s first blog [add link] , on the forthcoming digitization of copyright records.

The digitization of copyright records for music will be an enormous boon to people trying to clear music rights. But it also has huge implications for music scholarship and for everyday folks. Just ask Uncle Bennie.

My great uncle Bernard McLaughlin was a classically-trained pianist and composer based in Boston. With his brothers, Bill and my grandfather Jack, the McLaughlin Brothers played hotels and dance halls in Boston and toured throughout New England, New York City, and the Hudson River Valley. For the rest of his long life, he made his living through music and writing songs.

One day during a tour of the Copyright Office, on a lark I looked up Uncle Bennie in the card catalog. My chance visit led to the discovery of lost songs that mostly hadn’t been seen since Uncle Bennie sent them in for copyright deposit. I was astounded to find that he had registered 42 songs through 1936, most still unpublished. It’s an amazing peek into popular history: songs like “How I Love to Ride in a Rumble Seat” (1928), “What Is This Power I have Over Women” (1928), “Looking Through the Radio” (1929) [about the invention of television], “Everyone’s Economizing Now” (1931), “If Women Start Dressing Like Men” (1934), and “So Says Mussolini”(1935).

Uncle Bennie is our family’s musical success story; a couple of his songs were recorded and are still played, and he’s even represented on YouTube playing the piano. But we had no clue about the hard work and persistence behind that success. Here’s a struggling musician, during the Depression, who invests in the American dream by regularly scraping together the cash for copyright registration. The card catalog is filled with such stories. It’s an incredible resource.

Now, before the digitization of the Copyright Office’s records, obtaining lost music like Uncle Bennie’s was a hard slog. I had to go to the Copyright Office, hand-copy the cataloging information by pencil (pens are banned around the card catalog), carry it down to the Performing Arts Reading Room, wait for the songs to arrive from off-site storage, and then bring them home to plunk at on my piano to bring this music back to life for the first time in over 70 years. Now, sometime within a decade or so, at least the first step will be just a few keystrokes away.

Artists have a lot on their plate. Not only are we frequently on the hunt for ways to bring something new and special to our work, we are constantly seeking out happiness, optimism, and motivation in our struggles for recognition. On our mission to stay positive we often neglect to acknowledge the things that keep us from feeling the way we want to about our outlooks for the future.

It’s likely that a handful of the deadly sins of creative thinking have entered your mental workspace at some point or another. By becoming aware of what freezes your creative process, you’ll be better equipped to banish negative thoughts next time they come around.

1. Believing you are not a creative person

Buying into the common idea that creativity only belongs to certain people will keep you far away from it. Everyone has some level of creativity, albeit some more than others. If you find yourself drawn to creative activities, there is no reason why you can’t be as good as a professional if you work hard enough at it.

2. Fear of failure

Many people prefer achieving nothing over trying and failing because they equate failure with being worthless. A bad piece of art will not define your career if you go on to produce better art. Failure is an ingredient in success.

3. Failure to act

James Cameron, director of Avatar and Titanic said:

“There are many talented people who haven’t fulfilled their dreams because they over thought it, or they were too cautious, and were unwilling to make the leap of faith.”

Thoughts do not translate into action. You are solely responsible for producing a tangible artistic product. Your first foray into a craft doesn’t have to be an instant hit. Understand that learning from your mistakes applies to creative work just as much as the rest of your life.

4. Failing to produce ideas

The fastest way to stop tearing apart the creative works of others is to try it yourself. Sitting down to write a song is a fast wake-up call to how complex it can be – Leonard Cohen said it took him two years to write his signature song “Hallelujah.” J.K. Rowling outlined the plot for five years before she drafted the first Harry Potter book. Producing good work is hard.

It will also open your eyes to how much time you waste in being a critic. Being a critic is an entire career path in itself. Unless you plan on becoming a critic, channel your energy into your own work and use your time to come up with fresh ideas. The media may try to convince you that overnight success is a commonality, but most artists will tell you this is not true. Everyone needs to elect a starting point for themselves.

Once you’ve brainstormed and come up with your own ideas, don’t give your inner critic the free rein to come up with reasons why your ideas can’t be executed. Just proceed with them and let the artistic journey unfold on its own.

5. Not looking at things in different ways

Not every problem you face will have mutually exclusive answers. Seeking out answers that may not follow your usual line of logic can lead you to conclusions you did not think possible at first. Do not close off alternative lines of thought when immediately presented with a problem. Instead, consider a new or unfamiliar approach.

6. Failure to accept personal responsibility

Most people seek to blame unwanted circumstances on their current situations rather than consider how their actions have affected an outcome. If you work at it, you can change your attitude and approach to important creative tasks. Every vice has its remedy, be it procrastination, negativity, or a lack of discipline. Life does allow U-turns; and the old adage that it’s never too late exists for a reason.

Search engine optimization (SEO) is the process of improving the visibility of a website or a web page in search engines via the "natural" or un-paid ("organic" or "algorithmic") search results. In general, the earlier (or higher ranked on the search results page), and more frequently a site appears in the search results list, the more visitors it will receive from the search engine's users. SEO may target different kinds of search, including image search, local search, video search, academic search,^[1] news search and industry-specific vertical search engines.

As an Internet marketing strategy, SEO considers how search engines work, what people search for, the actual search terms typed into search engines and which search engines are preferred by their targeted audience. Optimizing a website may involve editing its content and HTML and associated coding to both increase its relevance to specific keywords and to remove barriers to the indexing activities of search engines. Promoting a site to increase the number of backlinks, or inbound links, is another SEO tactic.

The acronym "SEOs" can refer to "search engine optimizers," a term adopted by an industry of consultants who carry out optimization projects on behalf of clients, and by employees who perform SEO services in-house. Search engine optimizers may offer SEO as a stand-alone service or as a part of a broader marketing campaign. Because effective SEO may require changes to the HTML source code of a site and site content, SEO tactics may be incorporated into website development and design. The term "search engine friendly" may be used to describe website designs, menus, content management systems, images, videos, shopping carts, and other elements that have been optimized for the purpose of search engine exposure.

History

Webmasters and content providers began optimizing sites for search engines in the mid-1990s, as the first search engines were cataloging the early Web. Initially, all webmasters needed to do was submit the address of a page, or URL, to the various engines which would send a "spider" to "crawl" that page, extract links to other pages from it, and return information found on the page to be indexed.^[2] The process involves a search engine spider downloading a page and storing it on the search engine's own server, where a second program, known as an indexer, extracts various information about the page, such as the words it contains and where these are located, as well as any weight for specific words, and all links the page contains, which are then placed into a scheduler for crawling at a later date.

Site owners started to recognize the value of having their sites highly ranked and visible in search engine results, creating an opportunity for both white hat and black hat SEO practitioners. According to industry analyst Danny Sullivan, the phrase "search engine optimization" probably came into use in 1997.^[3] The first documented use of the term Search Engine Optimization was John Audette and his company Multimedia Marketing Group as documented by a web page from the MMG site from August, 1997.^[4]

Early versions of search algorithms relied on webmaster-provided information such as the keyword meta tag, or index files in engines like ALIWEB. Meta tags provide a guide to each page's content. Using meta data to index pages was found to be less than reliable, however, because the webmaster's choice of keywords in the meta tag could potentially be an inaccurate representation of the site's actual content. Inaccurate, incomplete, and inconsistent data in meta tags could and did cause pages to rank for irrelevant searches.^[5]^{[unreliable source?]} Web content providers also manipulated a number of attributes within the HTML source of a page in an attempt to rank well in search engines.^[6]

By relying so much on factors such as keyword density which were exclusively within a webmaster's control, early search engines suffered from abuse and ranking manipulation. To provide better results to their users, search engines had to adapt to ensure their results pages showed the most relevant search results, rather than unrelated pages stuffed with numerous keywords by unscrupulous webmasters. Since the success and popularity of a search engine is determined by its ability to produce the most relevant results to any given search, allowing those results to be false would turn users to find other search sources. Search engines responded by developing more complex ranking algorithms, taking into account additional factors that were more difficult for webmasters to manipulate.^{[original research?]}

Graduate students at Stanford University, Larry Page and Sergey Brin, developed "backrub," a search engine that relied on a mathematical algorithm to rate the prominence of web pages. The number calculated by the algorithm, PageRank, is a function of the quantity and strength of inbound links.^[7] PageRank estimates the likelihood that a given page will be reached by a web user who randomly surfs the web, and follows links from one page to another. In effect, this means that some links are stronger than others, as a higher PageRank page is more likely to be reached by the random surfer.

Page and Brin founded Google in 1998. Google attracted a loyal following among the growing number of Internet users, who liked its simple design.^[8] Off-page factors (such as PageRank and hyperlink analysis) were considered as well as on-page factors (such as keyword frequency, meta tags, headings, links and site structure) to enable Google to avoid the kind of manipulation seen in search engines that only considered on-page factors for their rankings. Although PageRank was more difficult to game, webmasters had already developed link building tools and schemes to influence the Inktomi search engine, and these methods proved similarly applicable to gaming PageRank. Many sites focused on exchanging, buying, and selling links, often on a massive scale. Some of these schemes, or link farms, involved the creation of thousands of sites for the sole purpose of link spamming.^[9]

By 2004, search engines had incorporated a wide range of undisclosed factors in their ranking algorithms to reduce the impact of link manipulation. Google says it ranks sites using more than 200 different signals.^[10] The leading search engines, Google, Bing, and Yahoo, do not disclose the algorithms they use to rank pages. SEO service providers, such as Rand Fishkin, Barry Schwartz, Aaron Wall and Jill Whalen, have studied different approaches to search engine optimization, and have published their opinions in online forums and blogs.^[11]^[12] SEO practitioners may also study patents held by various search engines to gain insight into the algorithms.^[13]

In 2005, Google began personalizing search results for each user. Depending on their history of previous searches, Google crafted results for logged in users.^[14] In 2008, Bruce Clay said that "ranking is dead" because of personalized search. It would become meaningless to discuss how a website ranked, because its rank would potentially be different for each user and each search.^[15]

In 2007, Google announced a campaign against paid links that transfer PageRank.^[16] On June 15, 2009, Google disclosed that they had taken measures to mitigate the effects of PageRank sculpting by use of the nofollow attribute on links. Matt Cutts, a well-known software engineer at Google, announced that Google Bot would no longer treat nofollowed links in the same way, in order to prevent SEO service providers from using nofollow for PageRank sculpting.^[17] As a result of this change the usage of nofollow leads to evaporation of pagerank. In order to avoid the above, SEO engineers developed alternative techniques that replace nofollowed tags with obfuscated Javascript and thus permit PageRank sculpting. Additionally several solutions have been suggested that include the usage of iframes, Flash and Javascript. ^[18]

In December 2009, Google announced it would be using the web search history of all its users in order to populate search results.^[19]

Google Instant, real-time-search, was introduced in late 2009 in an attempt to make search results more timely and relevant. Historically site administrators have spent months or even years optimizing a website to increase search rankings. With the growth in popularity of social media sites and blogs the leading engines made changes to their algorithms to allow fresh content to rank quickly within the search results.^[20]

By 1997, search engines recognized that webmasters were making efforts to rank well in their search engines, and that some webmasters were even manipulating their rankings in search results by stuffing pages with excessive or irrelevant keywords. Early search engines, such as Altavista and Infoseek, adjusted their algorithms in an effort to prevent webmasters from manipulating rankings.^[21]

Due to the high marketing value of targeted search results, there is potential for an adversarial relationship between search engines and SEO service providers. In 2005, an annual conference, AIRWeb, Adversarial Information Retrieval on the Web,^[22] was created to discuss and minimize the damaging effects of aggressive web content providers.

Companies that employ overly aggressive techniques can get their client websites banned from the search results. In 2005, the Wall Street Journal reported on a company, Traffic Power, which allegedly used high-risk techniques and failed to disclose those risks to its clients.^[23] Wired magazine reported that the same company sued blogger and SEO Aaron Wall for writing about the ban.^[24] Google's Matt Cutts later confirmed that Google did in fact ban Traffic Power and some of its clients.^[25]

Some search engines have also reached out to the SEO industry, and are frequent sponsors and guests at SEO conferences, chats, and seminars. Major search engines provide information and guidelines to help with site optimization.^[26]^[27] Google has a Sitemaps program^{[dead link]}^[28] to help webmasters learn if Google is having any problems indexing their website and also provides data on Google traffic to the website. Bing Toolbox provides a way from webmasters to submit a sitemap and web feeds, allowing users to determine the crawl rate, and how many pages have been indexed by their search engine.

Methods

Getting indexed

The leading search engines, such as Google, Bing and Yahoo!, use crawlers to find pages for their algorithmic search results. Pages that are linked from other search engine indexed pages do not need to be submitted because they are found automatically. Some search engines, notably Yahoo!, operate a paid submission service that guarantee crawling for either a set fee or cost per click.^[29] Such programs usually guarantee inclusion in the database, but do not guarantee specific ranking within the search results.^{[dead link]}^[30] Two major directories, the Yahoo Directory and the Open Directory Project both require manual submission and human editorial review.^[31] Google offers Google Webmaster Tools, for which an XML Sitemap feed can be created and submitted for free to ensure that all pages are found, especially pages that aren't discoverable by automatically following links.^[32]

Search engine crawlers may look at a number of different factors when crawling a site. Not every page is indexed by the search engines. Distance of pages from the root directory of a site may also be a factor in whether or not pages get crawled.^[33] Additionally, search engines sometimes have problems with crawling sites with certain kinds of graphic content, flash files, portable document format files, and dynamic content.^[34]

Preventing crawling

Main article: Robots Exclusion Standard

To avoid undesirable content in the search indexes, webmasters can instruct spiders not to crawl certain files or directories through the standard robots.txt file in the root directory of the domain. Additionally, a page can be explicitly excluded from a search engine's database by using a meta tag specific to robots. When a search engine visits a site, the robots.txt located in the root directory is the first file crawled. The robots.txt file is then parsed, and will instruct the robot as to which pages are not to be crawled. As a search engine crawler may keep a cached copy of this file, it may on occasion crawl pages a webmaster does not wish crawled. Pages typically prevented from being crawled include login specific pages such as shopping carts and user-specific content such as search results from internal searches. In March 2007, Google warned webmasters that they should prevent indexing of internal search results because those pages are considered search spam.^[35]

Increasing prominence

A variety of methods can increase the prominence of a webpage within the search results. Cross linking between pages of the same website to provide more links to most important pages may improve its visibility.^[36] Writing content that includes frequently searched keyword phrase, so as to be relevant to a wide variety of search queries will tend to increase traffic.^[36] Updating content so as to keep search engines crawling back frequently can give additional weight to a site. Adding relevant keywords to a web page's meta data, including the title tag and meta description, will tend to improve the relevancy of a site's search listings, thus increasing traffic. URL normalization of web pages accessible via multiple urls, using the "canonical" meta tag^[37] or via 301 redirects can help make sure links to different versions of the url all count towards the page's link popularity score.

Image search optimization

Image search optimization is the process of organizing the content of a webpage to increase relevance to a specific keyword on image search engines. Like search engine optimization, the aim is to achieve a higher organic search listing and thus increasing the volume of traffic from search engines.

Image search optimization techniques can be viewed as a subset of search engine optimization techniques that focuses on gaining high ranks on image search engine results.

Unlike normal SEO process, there isn't much to do for ISO. Making high quality images accessible to search engines and providing some description about images is almost all that can be done for ISO.

White hat versus black hat

SEO techniques can be classified into two broad categories: techniques that search engines recommend as part of good design, and those techniques of which search engines do not approve. The search engines attempt to minimize the effect of the latter, among them spamdexing. Industry commentators have classified these methods, and the practitioners who employ them, as either white hat SEO, or black hat SEO.^[38] White hats tend to produce results that last a long time, whereas black hats anticipate that their sites may eventually be banned either temporarily or permanently once the search engines discover what they are doing.^[39]

An SEO technique is considered white hat if it conforms to the search engines' guidelines and involves no deception. As the search engine guidelines^[40]^[26]^[27] are not written as a series of rules or commandments, this is an important distinction to note. White hat SEO is not just about following guidelines, but is about ensuring that the content a search engine indexes and subsequently ranks is the same content a user will see. White hat advice is generally summed up as creating content for users, not for search engines, and then making that content easily accessible to the spiders, rather than attempting to trick the algorithm from its intended purpose. White hat SEO is in many ways similar to web development that promotes accessibility,^[41] although the two are not identical.

Black hat SEO attempts to improve rankings in ways that are disapproved of by the search engines, or involve deception. One black hat technique uses text that is hidden, either as text colored similar to the background, in an invisible div, or positioned off screen. Another method gives a different page depending on whether the page is being requested by a human visitor or a search engine, a technique known as cloaking.

Search engines may penalize sites they discover using black hat methods, either by reducing their rankings or eliminating their listings from their databases altogether. Such penalties can be applied either automatically by the search engines' algorithms, or by a manual site review. One infamous example was the February 2006 Google removal of both BMW Germany and Ricoh Germany for use of deceptive practices.^[42] Both companies, however, quickly apologized, fixed the offending pages, and were restored to Google's list.^[43]

As a marketing strategy

SEO is not an appropriate strategy for every website, and other Internet marketing strategies can be more effective, depending on the site operator's goals.^[44] A successful Internet marketing campaign may also depend upon building high quality web pages to engage and persuade, setting up analytics programs to enable site owners to measure results, and improving a site's conversion rate.^[45]

SEO may generate an adequate return on investment. However, search engines are not paid for organic search traffic, their algorithms change, and there are no guarantees of continued referrals. Due to this lack of guarantees and certainty, a business that relies heavily on search engine traffic can suffer major losses if the search engines stop sending visitors.^[46] It is considered wise business practice for website operators to liberate themselves from dependence on search engine traffic.^[47] Seomoz.org has suggested that "search marketers, in a twist of irony, receive a very small share of their traffic from search engines." Instead, their main sources of traffic are links from other websites.^[48]

International markets

Optimization techniques are highly tuned to the dominant search engines in the target market. The search engines' market shares vary from market to market, as does competition. In 2003, Danny Sullivan stated that Google represented about 75% of all searches.^[49] In markets outside the United States, Google's share is often larger, and Google remains the dominant search engine worldwide as of 2007.^[50] As of 2006, Google had an 85-90% market share in Germany.^[51] While there were hundreds of SEO firms in the US at that time, there were only about five in Germany.^[51] As of June 2008, the marketshare of Google in the UK was close to 90% according to Hitwise.^[52] That market share is achieved in a number of countries.

As of 2009, there are only a few large markets where Google is not the leading search engine. In most cases, when Google is not leading in a given market, it is lagging behind a local player. The most notable markets where this is the case are China, Japan, South Korea, Russia and the Czech Republic where respectively Baidu, Yahoo! Japan, Naver, Yandex and Seznam are market leaders.

Successful search optimization for international markets may require professional translation of web pages, registration of a domain name with a top level domain in the target market, and web hosting that provides a local IP address. Otherwise, the fundamental elements of search optimization are essentially the same, regardless of language.^[51]

Legal precedents

On October 17, 2002, SearchKing filed suit in the United States District Court, Western District of Oklahoma, against the search engine Google. SearchKing's claim was that Google's tactics to prevent spamdexing constituted a tortious interference with contractual relations. On May 27, 2003, the court granted Google's motion to dismiss the complaint because SearchKing "failed to state a claim upon which relief may be granted."^[53]^[54]

In March 2006, KinderStart filed a lawsuit against Google over search engine rankings. Kinderstart's website was removed from Google's index prior to the lawsuit and the amount of traffic to the site dropped by 70%. On March 16, 2007 the United States District Court for the Northern District of California (San Jose Division) dismissed KinderStart's complaint without leave to amend, and partially granted Google's motion for Rule 11 sanctions against KinderStart's attorney, requiring him to pay part of Google's legal expenses.^[55]^[56]
